In consideration of participating at Empyrean Arts, LLC, I represent that I understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the Activity. I fully understand that this Activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, or in-actions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the "releasees" named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the Activity. I hereby release, discharge, and covenant not to sue Empyrean Arts, LLC, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsor, advertisers, and if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the "Releasees" or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage, or cost, which any may incur as the result of such claim. I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement of assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect. I confirm that I am participating in any and all AradiaTM Fitness USA and Empyrean Arts classes for personal use only and I acknowledge that the classes I am participating in are not structured or intended to prepare anyone to be a pole dance, aerial arts, contortion, or fitness instructor. Only individuals who have been accepted into and completed the AradiaTM Fitness and/or Empyrean Arts certification program are legally able to teach AradiaTM Fitness and/or Empyrean Arts classes and/or any portion of an AradiaTM Fitness and/or Empyrean Arts class. AradiaTM Fitness and/or Empyrean Arts will pursue legal action against any person teaching any AradiaTM Fitness and/or Empyrean Arts classes or any portion of original AradiaTM Fitness and/or Empyrean Arts choreography that does not have a valid certification.

Location & Arrival - Empyrean Arts (EA) is located on the right side (west side) of the 32 Banks Ave. building in suites 107 & 108. Plan to arrive 10-15 minutes early, providing enough time to park, get dressed & ready for class. Students arriving 5 or more minutes late to class will not be permitted to attend & will not be refunded. Dressing rooms are located within the studio as well as storage for your belongings. Bathrooms & water fountains are located in the hallway that we share with our neighboring businesses. We have snacks, drinks, & merchandise available for purchase. Parking - Free parking can be found in a small gravel lot located on Buxton Ave., directly behind our building (beside Green Man Brewery). Free street parking is available on Banks Ave., Coxe Ave., Church St., Collier Ave., Buxton Ave., & other surrounding streets. Additionally, there are 4 paid parking lots on Banks Ave. near the studio. These lots do enforce towing for lack of payment. Drop-in Students - We allow drop-in students in the event that there is space in class. We strongly encourage signing up in advance as space is limited. Cancellations - Cancellations must occur via your student account before the 12 hours leading up to your visit to avoid losing your credit. Cancelling within the 12 hours leading up to your visit will result in the loss of your credit. If within two hours of a class there are two or less students signed up, EA reserves the right to cancel the class. Students will not be charged if EA should need to cancel due to low sign ups, instructor emergency, or inclement weather. The class credit will go back into your account for future use. Should you miss a class from a series, EA will give you 2 free open studio hours. Because series credit types are specific to the series only, they cannot be used to sign up for other classes outside of the series. Classes - Classes are non-refundable & non-transferable (cannot be transferred or gifted to another student). To pay for a class for someone else, purchase a gift certificate or with your credit card under their account. Expiration dates start from the time of purchase & are not extendable. Pricing & expiration date information can be found on our website via the “Pricing” tab. Private Lessons & Parties - Private lessons & parties require full payment in advance to reserve studio and instructor time. To schedule your private lesson or party, email us at firstname.lastname@example.org, or text/call us at 828-782-3321. Private parties must give a cancellation notice of at least 48 hours for full refund. Spectators - All attendees of classes, private lessons, workshops, & parties must complete registration & payment prior to the start of the scheduled appointment. Visitors are not permitted to watch group classes, private lessons, workshops, or parties. Open Studio - Open studio is a supervised training time in which students can work out, stretch, & hang with other students. Teaching & skill sharing during open studio is not permitted. If you have a question/concern about a skill, feel free to ask the open studio host. Only trained staff members may rig equipment, so ask for assistance from a staff member if you need anything adjusted for you. Visitors & spectators are permitted during open studio hours. Cameras, Videos, & Notes - Written notes are encouraged as electronic devices are not permitted during group classes. Please respect others privacy in the studio. Pictures & videos are permitted during the following times: private lessons (per instructor approval), parties, open studio, private studio rental, & within the 15 minutes directly following a group class (before the start of the next class). Youth Classes - Students under the age of 18 must be accompanied by a parental guardian to sign a consent waiver upon their first studio visit or have their parental guardian complete a student account for them online through our website. All group classes are for students ages 12 and up. On occasion, a teacher may make exceptions for particularly mature students. Attire - For all beginning level classes at EA, dress as if you’re heading to a yoga class (Capri-length leggings & supportive top free of any metal like zippers or buttons). As students progress in pole classes, shorts are encouraged for better grip on the pole. Wear class appropriate attire in the studio, & be fully clothed when entering & exiting the studio. Wearing undergarments only is not allowed during pole activities. Street shoes must be removed before entering the classroom. Pole heels & dressing up are always optional & welcomed if desired. Behavior - Anyone under the influence of alcohol or drugs will not permitted within the studio. Disrespectful behavior is unacceptable and EA firmly stands behind our mission of providing a safe & supportive environment for anyone wishing to visit the studio.
